Terms & Conditions

1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the Battery Centre website and your purchase of any products from us. By accessing the website, placing an order, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the site or place an order.

2. Eligibility

By ordering, you represent that all information you provide is accurate and that you are authorized to use the payment method selected.

3. Orders, Acceptance & Cancellation

All orders are subject to acceptance and availability. We may refuse or cancel any order, in whole or in part, for reasons including suspected fraud, pricing errors, stock unavailability, or restrictions on shipping batteries.

When you place an order, you will receive an order confirmation email. This confirmation does not mean your order has been accepted; acceptance occurs when we ship the product.

We reserve the right to limit quantities and to discontinue products at any time.

Backorders and pre-orders: if an item is temporarily out of stock, we may hold your order and ship when stock arrives. You will not be charged for backordered items until they ship.

4. Pricing, Payment & Sales Tax

All prices are in US dollars (USD) and are subject to change without notice.

The price charged is the price shown at checkout, which may include discounts applied at that time.

We accept Visa, Mastercard, American Express, Apple Pay, Google Pay, and PayPal. Payment is due at the time of order.

Sales tax is added at checkout where required by law, based on the shipping destination and the rate in effect at the time of purchase.

We may verify and pre-authorize payment details before shipping. If a payment fails, we may cancel the order and will notify you.

5. Product Information & Compatibility

Product descriptions, images, specifications, and compatibility lists are provided for identification purposes and are believed to be accurate at the time of listing; we do not warrant that they are error-free, complete, or current.

Our batteries are aftermarket replacement products, not original equipment manufacturer (OEM) parts. All brand names, product names, and logos are trademarks of their respective owners and are used solely to describe compatibility. We are not affiliated with, or endorsed by, any original equipment manufacturer unless expressly stated.

It is your responsibility to verify that a battery is compatible with your device before purchase. If you are unsure, contact us before ordering.

6. Shipping, Delivery & Risk of Loss

Shipping terms are described in our Shipping Policy. Title to, and risk of loss for, products passes to you upon delivery to the carrier. We are not liable for delays caused by carriers, weather, customs, or other events outside our reasonable control. Delivery dates provided at checkout are estimates, not guarantees.

7. Returns, Exchanges & Refunds

You may return most items within 30 days of delivery in new, unused condition with original packaging. A Return Merchandise Authorization (RMA) number is required; returns without an RMA may be refused.

Refunds are issued to the original payment method within 7–10 business days after we receive and approve the return, minus any original shipping charges.

Non-returnable items: batteries that have been installed, physically damaged, modified, or whose labels have been removed or tampered with (the product label is the warranty seal); custom or special orders; items sold as open-box or clearance, unless defective.

Defective items: if a product is defective within 30 days of delivery, we will exchange it or refund you, and we will provide a prepaid return label. See our Warranty page for coverage after 30 days.

The buyer is responsible for return shipping costs for non-defective returns.

8. Limited Warranty & Disclaimer

Our products are covered by the limited warranties described on our Warranty page.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BATTERY CENTRE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR DAMAGE TO DEVICES OR OTHER PROPERTY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE WEBSITE OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS IN THAT ORDER.

Battery safety is your responsibility as well: use only the specified charger, follow all warnings on the product, and do not disassemble, short-circuit, crush, or incinerate batteries.

10. Indemnification

You agree to indemnify and hold harmless Battery Centre and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the website, your violation of these Terms, or your use of any product in a manner not intended or permitted.

11. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of Battery Centre or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any content without our prior written consent.

12. Prohibited Uses

You agree not to use the website to: violate any law or regulation; infringe the rights of others; transmit viruses or harmful code; interfere with the operation of the site; attempt to gain unauthorized access to our systems; or use automated tools (scrapers, bots) to harvest data from the site.

13. Third-Party Links

Our website may contain links to third-party websites (e.g., USPS, UPS, payment providers). We are not responsible for the content, policies, or practices of those sites. Links are provided for convenience only.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, pandemics, strikes, carrier outages, power failures, or interruptions in supply.

15. Governing Law, Jurisdiction & Class Action Waiver

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your purchase shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

CLASS ACTION WAIVER: YOU AND BATTERY CENTRE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If a dispute arises, we encourage you to contact us first at info@batterycentre.com and we will work with you in good faith to resolve it quickly and fairly.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

17. Waiver & Entire Agreement

Our failure to enforce any provision does not constitute a waiver of that provision. These Terms, together with our Privacy Policy, Shipping Policy, and Warranty, constitute the entire agreement between you and Battery Centre regarding your use of the website and purchase of products.

18. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the latest revision. Continued use of the website or placement of an order after changes take effect constitutes acceptance of the revised Terms.
